Dealing With a Crook Criminally

My mom read this story to me, http://www.toledoblade.com/apps/pbcs.dll/article?AID=/20091205/NEWS02/912050386 . I think the guy was right to confront the intruder, but pulling the trigger after the guy had his hands up in the air seems kind of unwarranted. Of course, if the "victim" had shells in the magazine no one would probably have heard about a crook who had his hands up. I wonder why the "victim" even mentioned that. Unless he was hurting so badly from the beatdown that he did not have the presence of mind to lie about attempting to shoot a crook who had his hands up. Hopefully, it sends a message to other crooks to expect no "fairplay" or "mercy" when they enter a man's home.

Perhaps his hands were up, but, then made an aggressive move on the victim and the Blade failed to mention the aggressive move.

Agreed - what is the point in keeping an unloaded pistol for personal protection? If you want to play the decoy game, just get a plastic toy gun - it is cheaper.

Just don't try to shoot the toy pistol - you will look even more ridiculous.

Cops should leave it to the homeowner to deal with intruders. A cop would be in a lot of trouble if he shot a man who had raised his hands to show he was unarmed. Whereas a homeowner can gun down anyone who comes in his home under the "castle" doctrine whether he surrenders or not. Looks like we really don't need cops anymore.

I guess the good guy also ended up with a broken skull. This is the perfect reason why NO ONE except me touches my firearms. My wife knows where they are at, but knows they are there only if she needs it. It's a costly mistake that could have been avoided.

Im with the consensus, but a couple questions:

He had the man with his hands up, THEN pulled the trigger?

Was he trying to shoot the bad guy, or put a hole in his own ceiling?

Billy: The intruder may have taken a swing at him. That doesn't make much sense to me either. I mean, if you're going to ding the guy, why bother with the reach for the sky business?

The victim then pulled the trigger, but the gun did not fire, because it was not loaded, according to the police report." I guess that would tend to bring out the fight/flight response in anyone. Remember, make sure you're gun is loaded before you gun down your prisoner otherwise he might beat you over the head with an empty gun. He'll be having an adrenaline rush, too. If you pull the trigger you better have a round in the chamber.
