Ottawa Hills Police Shooting

The case of ex-Officer White and his proclivity to shoot suspects in the back has already been discussed to death. The jury's back and sentencing is scheduled for June. If you'd like to see this menace to society spend some time in prison, I urge you to take a few minutes and write a letter to the judge:

Just let the judge do his job without outside influence. If you had supported a letter writing campaign to the jury you could be arrested for tampering. Why should this be any different?

Great post, jack, but I think that the fix is already in.....

The online docket in this case stopped daily entries on May 12.
There is no mention of his conviction or the Bond he was released on.

Usually when a person is out on bond and convicted, he is pulled in to await sentencing as his potential for flight increases. Not so in this case.....

Remember that Gary Cook is a former Assistant Prosecutor and carried a badge. Prosecutors are really the 'top cop' in the system because they are supposed to have the brains for it....

Judge or not, Cook is a former 'top cop', and cops all hang together.

He has to be sentenced to 5 years, minimum, and he has to serve every day of those five years pursuant to law. No exceptions. There is no fix. The only thing Judge Cook can do is give him more than 5 years.

Within about 30 days of Mr. White arriving at the prison where he will begin serving his time, his mugshot and profile will be uploaded to this website:

http://www.drc.state.oh.us/OffenderSearch/Search.aspx

People can visit the website and do a search for his name. The name of the institution, where he will be staying, will be available.

People can then find "other inmates" incarcerated at the same prison. If they wanted, they could pick out 50 or 100 names, and start writing letters to these "other inmates," telling them what Mr. White did to land himself in prison. They could even include newspaper clippings about the trial.

These other inmates might be grateful to get this information.

They could "watch out" for this guy (Mr. White)......in case he tries to hurt fellow inmates, or stick a shank in somebodies back.

JohnnyMac - since his days do not count as State time until he arrives at CRC, doesn't this initial month of freedom after a conviction count as part of the 'fix' ?

How about the undocketed terms and conditions of his bond ?

Perhaps Judge Cook will allow White to remain free pending appeal. That could conceiveably take two or three years.

THAT'S how the fix could be in.

WalterAnthony - the picture and sentencing information should appear on ODRC's
website 3-5 days after an inmate intakes at CRC (Correctional Reception Center in Orient, Ohio).

As far as sending information with the intent to harm an inmate in the DRC, you are sadly mistaken.
Your vigilante justice simply would not occur that way.

ODRC has a state-of-the-art mail system that copies any material sent to an inmate and records the sender's address.
Your type of material would not even be allowed in as it represents a threat to the security of the institution.

They also have a state-of-the-art telephone system at ODRC that can retrieve information for up to two years.

Be careful, sir.
You could end up as White's celly with that type of vigilante attitude.

CopCatcher - Thanks for reminding everyone, that the idea isn't anything that anyone should REALLY take......seriously. You'd think most people would understand that, but hey......maybe not.

Here's a question.

Will the administrators at the prison make every effort to ensure that Mr. White "is not" set-up in a cell block, with anybody that he has arrested before ?

I imagine it probably won't be a serious issue (concern) with Mr. White. Since he worked in Ottawa Hills, and then only worked part-time, for a couple years, he probably doesn't have a long list of people he has helped put in prison. On the other hand, if it was a veteran police officer from Toledo, Cleveland, Columbus or Cincinnati, that helped put a lot of people behind bars, over many years, that would probably be an issue to address.

WalterAnthony - with the venum and hate that has been posted about Ofc. White, your post was not read as sarcasm, but a call for his assault and murder.

White will be in protective custody for every day of his jail time. That is the equivalent of solitary confinement for the full boat. The fact that he was an OH cop would not slow the dirtbags in prison from killing him very quickly.

In reading the statute, I think the minimum is 4 years, but it could be 5 as a First degree felony with gun spec.

He was indicted for a F-2 w/ gun spec.

That's the kick about Judge Gary Cook's not posting the conviction and release on bond information.
It is not known WHAT he was found guilty of, exactly. Or the terms of his release on bond after conviction.

TAHL- You may know the answer to this- Isn't there currently a law suit about gun specs being applied to individuals that carry a gun as part of their job? Thought I had heard it somewhere.

The most likely explanation of why the Lucas County website is not yet updated is that Judge Cook's office personnel haven't entered the information. With the jury deliberation ending late Friday night, I would guess everyone went home without entering the information.

The gun spec carries 3 years. The F2 Felonious Assault carries 2-8 years. The spec time is mandatory and consecutive to the sentence on the underlying offense. The judge has to choose a sentence from the 2-8 year range in order for the spec time to "attach" to something, he can't just give him the spec time alone. Thus, the minimum is 2 plus the 3 on the spec.

Under the new Judicial Release rules, a person sentenced to exactly 5 years cannot get out early. There is no provision for early release on aggregate sentences of exactly 5 years. If he gets 6-9 years total, he can get out after serving 5.

The only thing that raises an eyebrow is the judge not taking him into custody right away. That is out of the ordinary, especially when a defendant is looking at mandatory time.

Did anyone get his passport?

JohnnyMac - usually a Clerk will post Events on a docket as they occur daily. Not so in this case, for some unknown reason.

The last entry in this case was made 5/12/10. That was six days ago. I have never seen anything like this in LCCCP.

The public has only been told that "he has been found guilty".

Of what, exactly ????

And not to belabor the issue, but did the jury instructions allow for conviction of a lesser included offense ? W/out the gun spec. ???

I have seen 1 year sentences given in gun spec cases.

I worked for LCCCP for 3 years and came away with the realization that Common Pleas judges are very, very powerful people and can do almost what they please when they sentence someone, ORC be damned.

I don't know what lesser offenses the defense or the State requested, but I would guess none. The issue was justification, not a difference of opinion on what the real facts were.

The jury did have to make a seperate finding of guilty beyond a reasonable doubt on the gun spec. They could have found him not guilty of the spec and still convicted him on the Felonious Assault, but that would have been rather contradictory, although juries do lose their way quite often.

There is a 1 year gun spec in Ohio, but that is for merely possessing a gun during the commission of a crime. The gun was obviously brandished in this case, hence the conviction.

The judge's hands are tied here. White is getting 5 years, minimum.

JM - today the clerk of former police officer and now Judge Gary Cook made an entry in the docket of this case.

It skipped the trial resumption on 5/13 and went from a 5/12 entry to a 5/18 entry that said the jury verdict was filed.

Finding of Guilty on a charge of Felonious Assault, no level
given. No mention of conviction on gun spec.

Anyone still clinging to that "5 years minimum" idea ?

All it means is the person in charge of entering the information is lazy, overwhelmed with work, or indifferent to accuracy.

Nah, just be careful who you make bets with, JohnnyMac. Making a bet with certain anonymous Internet posters is like giving a city job and vehicle to a guy with 14 DUI arrests: perhaps well-intentioned, but likely to end in regret.

JM - Is it possible that the Suppression Ruling against White could be reversed and the entire case remanded for further proceedings ?
And could the whole Gun Spec charge (and sentence) get tossed ?
The answers are yes and yes.

So has the sentence been handed down yet ? Of course not. Let's wait and see.
You can even bring wannabeemike along for the payoff.

BTW - do not affiliate yourself with known blog-hogs that consider themselves the epicenter of historical knowledge in Toledo.
One will have a young female student file sexual harassment charges against him in the very near future that will make it damn near impossible for him to find a job teaching.
You do not want to get caught up in what is coming his way.

As in the proposed incarceration of Thomas White, this thread is probably best put on hold for at least one-two years. It may be three-four years if Jerry P gets the good delay mileage out of the (Indictment of a Police Officer on Gun Specification) issue, surely taking it all the way to the Supremes, if necessary.
Excellent trial tactic.

The only real sentence White will have is the one he has with him when he shows up at the door of Corrections Reception Center, if and when.
As long as White remains free, that sentence from the trial court is more like a proposed sentence, pending review of the case by an Apellate Court.

And Ta-DAAAA !

The other charges full-steam ahead as a self-appointed internet cop. He spends untold hours daily in front of a computer screen, telling people how to think. As was recently observed by NotAgain,
if someone does not agree with this so-called historical (and everything else) know-it-all, they are condemned by him with the use of buzz words that are attention-getting - such as troll, obsessive, stalker......

Sorry - violence ain't my thing, hockeyfan. Also, I do not hide behind a screen name, and I put my name and reputation behind everything I write on the Web (click on my TT name if you are unfamiliar with who I am).

With all due respect, hockeyfan, I am not just playing "cute" here - the individual in question has been banned many times from this and other local websites for disruptive and threatening behavior, and he recently threatened on SB to "pay a visit" to my house (he knows the address). I don't "work this out like real men" when I am dealing with cyber and real-life stalkers, brother - I document the idiocy and turn it over to law enforcement when it crosses the line. In CopCatcher/El Mahico/Gary G.'s latest idiocy, he is dancing around libel (note the inflammatory and borderline sexual harassment BS above) and he will continue to do so as long as he gets an audience. The way this will probably play out is that CopCatcher (or whatever new name Gary creates - he has probably had two dozen screen names banned on local boards) will say something especially threatening or illegal, get the attention of the site owner, and then get banned. Then he will show up again in a few weeks with a new name, behave for a little while, and then his obsession with me will be too much for him to take, and the cycle will repeat.

That is, assuming Gary is just an Internet moron and not actually descending into Crazypantsville. If the latter is the case, then I suppose we will have ourselves a real situation. However, I suspect Gary is just a dude who is really unhappy with the way his life ended up, and he uses boards like this to make himself feel a little better. Perhaps I am serving a useful community role in providing Gary a way to vent his bile without actually having to carry out his violent fantasies.

Or perhaps he is just an a**hole. :-)

Appreciate the update.
My comments are not serious all the time. I was trying to bring some comic relief into what seemed an all too serious situation.
It is sad that someone pursues another to be so abusive. Over what? Expressing one's own opinion and thoughts? Like tv, if you don't like it, turn it off. If someone doesn't like what you have to say, don't read your posts/blog/etc.

In the interests of amusement I stopped at the Bier Stube today around 2:00 and asked the nice lady bartender about Internet sites and wagers. She regarded me with some alarm and told me she didn't know a thing about it.

My intent was to buy you a beer and to see if you were genuine. So - you either didn't tip the bartender to the wager, or the next nickel I find rolling up hill is going to have your picture on it.

How about one week from today?

I know, Mike, and thank you. He's just a spineless lonely wanker. He's also stalking my classmates page too and has tried on several occassions to gain access to my facebook account lol

I can say that I don't miss the daily email onslaught. All it took was an email with this: "THE US COMMUNICATIONS DECENCY ACT OF 1996" and suddenly the harassment stopped lol

In case Gary missed it, Chris banned my account after clarifying Gary's delusional perspective of reality over a year ago and I'm not internet desperate enough to make up 50 screen names to bypass that ban, let alone contribute to that psycho-laden blogsite. I'm still using my original accounts on ToledoTalk and GlassCityJungle. That in itself should speak volumes.

He can type anything he wants, but it clearly doesn't mean it's fact at all lol

I'm looking forward to "initdeeprightnow"'s contributions over there now that he's been banned again lol

And to contribute to this thread, I think Mr White's comments clearly disclose an entitled mind and should have never been a police officer. I can't understand how he got past the psyche test, personally.

I always wondered why Chris puts up with Gary's drunken shenanigans, and well... I still wonder. I would think that HistoryMike has some legal recourse for the threats that Gary posts, but what could Chris (or any other SysOp) do to enforce the "no trespassing" rule?

The Sixth District Court of Appeals in Lucas County heard arguments March 15, from both sides.

The panel of three judges is now considering the arguments and will decide if an appeal will be granted

Essentially, White is still free.

Ottawa Hills shooting case goes before appeals court
Nearly two years after an Ottawa Hills police officer was convicted of felonious assault for shooting and paralyzing a motorcyclist during a traffic stop, lawyers once again argued issues of the case -- this time before the Ohio 6th District Court of Appeals.

Judges Peter Handwork, Arlene Singer, and Stephen Yarbrough heard 30 minutes of argument before taking the case under advisement.

During her argument, attorney Deborah Rump said Thomas White was acting under a good-faith mistake when he fired a shot at Michael McCloskey and so, as a police officer, should be immune from criminal prosecution.

Court hears ex-officer's appeal in biker shooting case

White remains free on bond pending appeal. The panel of judges will release a written decision after they come to a consensus.

White shows absolutely no remorse at all for shooting and putting Michael McCloskey in a wheelchair for the rest of his life. White should be getting 25 to life in general population at a maximum security prison, but instead he's very likely to walk on this one.
